Buyer has two contracts out? Not cool! - Real Estate Webmasters


Why do you think you should postpone the inspection?

I see the OP may be from Dallas... In Texas, we have a Termination Option period, the buyer pays a fee to the seller for this termination privilege. During that Option Period of time, (5-14 days or so) the buyer has the option to terminate the contract and get their earnest money returned, for whatever reason. (The seller keeps the Termination Option money, maybe $10-$25/day.)

During the Option Period is when the inspection is done and any renegotiation occur, if the inspection turns up some things. On our MLS we mark the status as AO, Active Option, some agents avoid showing homes while in this status.

While I have not ever run into this situation, I have had clients ask me if we could write offers on 2 different homes at the same time, but we didn't ever have both homes get accepted contracts ... I really don't see that there is anything to prevent a buyer from having two homes under contract under this circumstance and it is a situation that I really wouldn't want to do.
